Marengo Man Arrested DUI Weapons Charge in DeKalb County

Aug 6, 2015 | DeKalb, Marengo

A 53 year old Marengo resident is facing DUI and weapons charges after he was arrested in the early morning hours in DeKalb County after he pulled into a driveway that was not his own.  He was charged with driving under the influence and having a blood alcohol lever of more than 0.08 percent.  Additional, he had a loaded .38 special in the center console of his vehicle.  He was taken to the DeKalb Sheriff’s Office and released Sunday after he posted $100 bail and surrendered his driver’s license, according to the Northwest Herald.

How can I legally transport a firearm in my vehicle?

Under Unlawful Use of Weapons (UUW) in the Criminal Code of the State of Illinois, all firearms in or on any vehicle must be unloaded and totally enclosed in a case.  Additionally, the person or persons transporting the firearms must have a valid FOID car.

Violating the UUW law by carrying a loaded firearm in your vehicle is a Class 4 Felony which, if convicted, carries a minimum prison sentence of 1 year with a maximum of 3 years and fines up to $25,000 years.

If you’ve been charged with UUW and a DUI at the same time, it’s a good idea to hire a defense attorney who is experienced in both DUI and Criminal Defense such as Attorney David B. Franks.  Contact us today for a free initial consultation.
